1. Introduction
Welcome to AnyWareX UG (“we,” “us,” “our”). By accessing and using our time tracking and attendance monitoring system, ClockTAM, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our service.
2. Service Description
ClockTAM provides a time tracking and attendance monitoring system that integrates TOTP (Time-Based One-Time Password) technology for attendance verification. The service includes features for managing time tracking, attendance, and geolocation data.
3. Registration and Account Management
Upon registration, the user will receive admin rights and can create accounts for managers and employees. Access to features is contingent upon subscription to the appropriate service tier.
4. Subscription and Payment
- Free Tier: Users on the free tier acknowledge that we are not responsible for data storage or functionality of the service.
- Paid Subscription: Payment for subscription is processed through PayPal. Failure to make payment or withdrawal of payment may result in deactivation of accounts and deletion of associated data.
5. Data Retention and Deletion
- During the Contract Term: We will retain data as required for the duration of the contract.
- After Contract Expiration: We will retain company accounts (admin accounts) for a minimum of two years and employee accounts for at least one year. After this period, we reserve the right to delete these accounts.
- Data Deletion Requests: Users can delete their own data or geolocation data at any time through the app.
6. Data Storage and Third-Party Services
- Storage: User profile pictures and company photos are stored in a secure cloud storage service. We do not disclose the name of this service.
- Email Communication: We use an email service provider for sending emails. The name of this service provider is not disclosed.
- Payment Processing: Payments are processed via PayPal.
7. Liability and Disclaimer
- Service Functionality: We do not guarantee uninterrupted service and are not liable for any loss or damage caused by technical issues, including but not limited to software updates or third-party infrastructure issues.
- Data Responsibility: We are not responsible for data loss or functionality issues for users on the free tier.
8. Termination
We reserve the right to terminate or suspend access to our service for any user who violates these terms or for any reason we deem necessary.
9. Changes to Terms
We may update these Terms and Conditions from time to time. Users will be notified of any changes, and continued use of the service constitutes acceptance of the revised terms.
